1. PRICES : The prices at which the customer purchases each product will be determined based on the quantity of products purchased, in accordance with the latest price list in force. The corresponding taxes must be added to said prices. All items may be subject to price variations without prior notice. The customer must consult the current price list before placing the order.

2. SHIPPING : Shipping costs are governed by the conditions established in our Shipping and Returns policy

3. DELIVERY TIME : all orders received will be delivered within a maximum of 5 business days, except in cases of force majeure.

4. PAYMENTS : In the event of total or partial non-payment of any order, on the due date, in application of Law 3/2004, of December 29, article 5, the amount due and unpaid will accrue corresponding late payment interest without the need for notice of due date or any summons from Nost Cosmetics, in addition to the Customer being responsible for any return costs that Nost Cosmetics may incur. Likewise, Nost Cosmetics will be empowered to suspend or cancel pending deliveries of products to the customer, as long as the order whose payment is due and payable is not paid, or to require advance payment for any new order.

5. COMPLIANCE AND CLAIMS : The customer's compliance, regarding the quantity of product delivered in respect of an order, will be carried out by the corresponding signature of the delivery document issued by the courier, provided that the customer does not communicate by e-mail to pedidos@nostcosmetics.com his/her total or partial disagreement within the following FORTY-EIGHT (48) hours.

6. RIGHT OF WITHDRAWAL : The customer has a period of 14 calendar days from the date of receipt of their order to exercise their right to withdraw without having to state any reason. Only products that have not been used and are returned in their original form and packaging and sealed will be accepted. In this case, the total amount of the order plus shipping costs will be refunded.

7. FORCE MAJEURE : Nost Cosmetics shall not be liable for any failure or delay in the fulfilment of its obligations to the customer, if this is motivated by any reason of chance or force majeure, including strikes, other labour or industrial contingencies, lack or impossibility of obtaining raw materials and products, etc. If the cause of force majeure continues for more than 2 months, Nost Cosmetics or the customer may cancel and void any current orders, without any compensation or indemnity being payable by Nost Cosmetics.

8. RESPONSIBILITY : The client will be solely responsible, exonerating Nost Cosmetics where applicable, for any damages arising from improper use, storage, conservation or handling of the products.

9. DATA PROCESSING : All data supplied by the client to Nost Cosmetics are subject to automated processing by Nost Cosmetics for the purpose of proper financial, accounting and administrative management. In accordance with the provisions of Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, the client has the right to exercise the rights of access, rectification, cancellation and, where appropriate, opposition by sending a written request to the following address: Nost Cosmetics, Ronda Narciso Monturiol, 4, office A-110 46980 Paterna (Valencia).

10. APPLICABLE LAW : The contractual relations between Nost Cosmetics and the client, subject to these General Conditions of Sale, will be governed solely by Spanish Law.

11. JURISDICTION AND JURISDICTION : For any matter related to the interpretation, execution or compliance of these commercial conditions, as well as for the resolution of all contentious issues arising from the contractual relations subject to the agreed general conditions of sale, the parties submit, expressly waiving any other jurisdiction that may apply to them, to the jurisdiction of the Courts and Tribunals of the city of Valencia.
